SCRUMYS TERMS AND CONDITIONS

Welcome to Scrumys!
• The terms and conditions (T&Cs) laid out below relate to the operation and management of all Scrumys sessions unless otherwise stated. No binding amendments can be made to the T&Cs unless made in writing between Scrumys and the parent.
• The T&Cs must be accepted by the parent (the legal guardian entering into the agreement) at time of online booking.
• No aspect of the Scrumys session plans may be shared by a participating parent or carer, to any third-party business who are involved in the same market as Scrumys; Additionally, parents or carers who participate in Scrumys session must not be directly or indirectly involved with any business in the same market as Scrumys, while active in membership and for a period of 12 months after.
• Scrumys reserves the right to cancel sessions, giving notice, and will refund session fees for sessions not operated.
• Agreement of the Scrumys T&Cs allows sharing of data within the Scrumys group.
• Scrumys will be indemnified by the Parent against all liability and loss which Scrumys may incur directly or indirectly due toany action of the parent, carer and/or child.
• Scrumys ask Parents to ensure government guidelines regarding pandemic controls are adhered to. No child should attend sessions if they are showing symptoms of COVID19 or have been in recent contact with someone showing symptoms. Due to the nature of COVID19, Scrumys cannot guarantee against an element of risk during sessions. The risks from participation in sessions – for parent, carer and child - are the sole responsibility of the parent. Any questions relating to COVID precautions should be address to sales@scrumys.com
• These terms and conditions constitute the entire agreement between Scrumys and the parent (the ‘parties) and supersedes prior agreements and understandings between the parties.
• This contract shall be governed by the laws of England and the parties submit to the exclusive jurisdiction of the English courts
Obligations of Participation
• The parent making the booking will be a legal guardian, and the contracting party with Scrumys.
• The parent will ensure that all information provided at booking is accurate and immediately notify Scrumys of any subsequent changes required.
• It is the parents’ responsibility to notify Scrumys of any medical conditions (SEN, SEND) at time of booking.
• Children and/or Parents & carers will not attend sessions if suffering from, or suspected to be carrying, a contagious infection or disease.
• During membership sessions (weekends sessions) parents must remain in the session at all times and are responsible for the safeguarding and conduct of the child(ren) in their care.
• Scrumys reserves the sole right to insist upon the removal of children and carers if considered necessary to safeguard the participants of the session or the coaches. In exceptional circumstances children and/or carers may be excluded if safety and behavioural standards cannot be adhered to.
• For school-based sessions, parents are responsible for ensuring children have the appropriate clothing, hydration, sunscreen and medicines available at the school and accessible by Scrumys coaches.
• For school-based sessions, parents will collect their children in a timely manner, observing Scrumys and the schools safeguarding procedures for pupil (child) dismissal.
• The parent will maintain their payment schedule. We require one months notice to cancel the membership.
• Fees are non-refundable unless by written consent of Scrumys.
Limitation of Liability
• Any claims against Scrumys must be made in writing within 30 days of incident, or the claim will be rejected. Aggregate claims cannot exceed fees paid within a period of three months.
• Scrumys operations do not accept responsibility in respect of loss, damage or expense incurred by a child, parent or carer arising directly or indirectly or in any way connected with the attendance of the child, parent or carer to any session, or any other act or omission by Scrumys operations.
• All warranties and conditions, whether implied by statute or otherwise, are excluded from this contract if nothing in this contract shall restrict or excluded liability for death or personal injury caused by the negligence of Scrumys operations or affects the statutory rights of the parent or child.
• The failure by either party to enforce at any time or for any period any one or more of the obligations arising under this contract shall not be a waiver of them or of the right at any time subsequently to enforce any or all such obligations.
Definitions and Terminology
• Bookings are made online through the website, where fees, locations and timings of sessions are detailed. Website’ is defined as scrumys.co.uk
• A ‘Booking’ relates to the online booking form for a child formembership and/or session(s).
• ‘Session(s)’ mean the Scrumys session as laid out on the Booking Form
• ‘Fees’ for each Scrumys offering are detailed on the website. ‘Fees’ relates to all chargeable session-related monies due.
• ‘Parent’ means the child’s legal guardian, and the contracting party with Scrumys. The parent will be responsible for payment of fees and for ensuring compliance with Scrumys terms and conditions.
• ‘Parties’ / ‘party’ means the contracting parent and Scrumys
• ‘Carer’ means the adult attending carer-supervised sessions with the child and who is responsible for their safety. This does not apply for sessions being run within the parameters of a school/nursery day.
• ‘Lead Coach’ means the individual hired by Scrumys or the Scrumys franchisee to manage and run individual sessions. Lead coaches may by changed by Scrumys as necessary.
• ‘Coach’ means any individual hired by Scrumys or the Scrumys franchisee to support in the operation sessions.
• ‘Child’ means the child participant specifically booked to attendthe session.
• ‘Location’ specifies the premises / site from which the sessions will operate
• ‘Membership’ means joining fees paid up front as laid out in the booking and are specific to particular session offerings.
• ‘School-based’ means a school or nursery through which Scrumys offers weekday clubs on school site. These are not parental supervised sessions.
• ‘Scrumys’ means the company Scrumys No. 1 LLP, or the Scrumys franchisee for the area, and are the contracting partyto this agreement.
• ‘Scrumys Operations’ means coaching staff, employees, agents or other representatives of the Scrumys company.
